Insurance Case
"Mrs N" tragically died in an accident on holiday abroad but there were no eye witnesses. Her husband was left to care for their young family. Although the couple were happily married, several years earlier there had been a row. Ever since, Mr N's mother-in-law had borne a grudge.
After the Funeral and Cremation our client's mother-in-law alleged that he had killed his wife. Mr N was then arrested and held in prison abroad. The insurance companies sat back and refused to pay the endowment policy. This was for a substantial sum which matured on Mrs N's death.
Mr N was later released from prison. He returned to the UK and had to give up his job to look after the children. He could not afford his mortgage and he then consulted Levi Solicitors. Although the mortgage was in arrears, we arranged for the Building Society to hold back from their threatened eviction proceedings. We investigated the whole case, interviewing 50 friends, neighbours, relatives, financial advisers and doctors.
We issued a Writ against the insurance companies who still refused to honour their insurance policies; they said the complaint in the foreign Court had still not been resolved, even though the British Police had investigated and were satisfied there had been no foul play.
Levi Solicitors made an application to the Court and the Insurance Companies' Defences were struck out. Judgment was granted to Mr N for £170,000 plus interest and our costs.
