Levi's triumph in the Court of Appeal
Levi Solicitors LLP have recently triumphed in the Court of Appeal with a family law decision which has provided guidance as to the support vulnerable people should be offered upon their release from prison following the breach of a family law act injunction.
The client in question had repeatedly breached an injunction obtained by a family member which prevented him from attending at her property. On the last breach he was sentenced to 21 months in prison. Levi Solicitors LLP successfully applied to the Court of Appeal for a reduction of the sentence, the result being that the sentence was reduced to 12 months.
In the leading judgment Lord Justice Lawrence-Collins required Levi Solicitors LLP to liaise with the relevant local authority to ensure that upon release from prison the vulnerable client is provided with housing and support in an attempt break the cycle of repeatedly breaching the injunction.
Representing the Appellant, Sarah Crowther described the judgment as “an interesting and important decision in which the Court of Appeal looked beyond an excessive sentence to the needs of the vulnerable upon release from prison and the responsibility for providing a package of support to rehabilitate them into the community”.
