No smoke without fire

 

From 1 July 2007, it will be a criminal offence to smoke or to permit smoking in certain enclosed spaces, including workplaces, in England. Is your business ready?

 

The new law introduces the concept of “smoke-free premises” which includes premises used as a place of work by more than one person (even if those who work there do so at different times, or only intermittently) and premises used as a place of work where members of the public might attend for the purpose of seeking or receiving goods or services from those working there (even if members of the public are not always present).

 

This definition extends to company cars that may be used by more than one person (even if at different times).

 

Anyone who occupies or is concerned in the management of smoke-free premises must:

 

  • put up "no-smoking" signs of a specific size with stipulated wording at every enterance;
  • ensure signs are displayed in vehicles in each compartment of the vehicle to which employees or the public have access; and
  • prevent anyone smoking on the premises

or risk a fine.

 

Smoking in smoke-free premises will also be a criminal offence, punishable by a fine or a fixed penalty.

 

Businesses need to prepare themselves to comply with the new laws on 1 July. Company policies should be updated to reflect the changes and implementation of a ban or partial ban in advance of 1 July may lessen the impact of the ban when it actually arrives.
