McCartney v McCartney…

 

Many thousands, of column inches have been written about the now famous divorce case of Sir James Paul McCartney and Heather Anne Mills McCartney.

 

I wish to approach this case from a different angle and ask the question “Should Mrs Mills McCartney have been legally represented at the final hearing of the application for financial provision?”.

 

My own answer is “YES”. You may ask why when she was awarded a staggering £23.8 million which to most people they would be able to live comfortably on for the rest of their lives. Mrs Mills McCartney however, did not agree and following the Judgment of Mr Justice Bennett she made various comments to the media as to how both she and their daughter’s lifestyle would have to change.

 

This was an extremely complicated case involving complex financial and legal arguments   Sir Paul was represented throughout the proceedings by highly trained professionals and in the Judgment where there were any contentious issues between them, the Judge found, in the main, in favour of Sir Paul. 

 

Most family lawyers accept that the award was at the bottom of the scale and I also believe that to be the case.   I consider had Mrs Mills McCartney been represented (as opposed to having advisers) she would have been likely to have received a higher award, probably at the top end of the scale which many had predicted to be £50 million.

 

Whilst the majority of divorce cases do not involve the complexities of this case they do have many important and difficult issues which need to be resolved.  Parties are more often than not better equipped to handle the emotional turmoil of the breakdown of their marriage with proper legal representation than without it.
