Over recent years we have worked on a number of high profile cases and this includes the recent Court of Appeal cases [D & Others -v- East Berkshire Community Health NHS Trust & Others, All England Law Reports [2003] 4 All ER 796]. Our clients' case succeeded in extending the law of negligence in recognising a child's entitlement to sue a Healthcare Professional (NHS Trust) and a Social Worker (Council Social Services) in the exercise of their statutory powers. A duty of care had not previously been recognised by the Courts as being owed by the Professionals in carrying out the statutory obligations.

Claims against professionals raise financial risks (which are usually insured) but also involve unwelcome threats to reputation.
