Have you been made redundant?
 
In the current difficult economic climate, many individuals are facing the risk of redundancy. A difficult job market means that many people cannot just move straight on into another role and try to forget what has happened; they are needing, now more than ever, to stand up for themselves if they have been badly treated.
 
Is the dismissal fair?
 
If your employer has put you at risk – or has already made you redundant, the team at Levi Solicitors may be able to help. We can look into the situation to assess whether you have been dismissed fairly or not – and if your dismissal is unfair, we can act on your behalf to take action against your former employer. You may be entitled to compensation if you have been unfairly dismissed.
 
Sometimes employers say that a role is redundant but there is actually no genuine redundancy scenario at law. This could mean the dismissal is unfair.
 
Where there is more than one member of staff in a “pool” of “at risk” employees, the employer needs to undertake a fair and objective selection process. If they fail to do so, this can make any resulting dismissal unfair.
 
Furthermore when an employer is faced with a possible redundancy situation it is required to:
 
·        look for ways to avoid compulsory redundancies, including identifying possible suitable alternative employment; and
·         undertake a consultation process in respect of the possible redundancies.
 
If an employer fails to carry out the above steps then the dismissal is likely to be unfair.
